Wrongful Death Michigan Lawsuit Filed For Mini-Blind Death of Infant

The Michigan personal injury lawyers at Buckfire & Buckfire P.C. have filed a wrongful death lawsuit against a Macomb County apartment complex in connection with the death of a 1-year-old girl. The child died on October 19, 2011 of strangulation injuries after becoming entangled in the mini-blind cord near her bed in her family’s rented unit in a Chesterfield Township apartment complex. Police did not press criminal charges against the girl’s parents as they found no wrongdoing.

However, the mini-blinds in which the girl was strangled to death had a dangerous loop cord. Putting in a simple safety device or shortening the blind cords and providing tassels could have prevented this tragedy. But the apartment owner or manager did not make these safety devices available to this family. According to the U.S. Consumer Product Safety Commission (CPSC), over the past decade or so, 102 children have been reported strangled by cords attached to window coverings. Hundreds of others have been severely injured. Many children have even suffered brain damage because when a child is strangled, oxygen to the brain can get cut off causing irreversible brain damage.

Spinal Cord Injuries Most Often Caused by Car Accidents

Spinal cord injuries, which involve damage to the spinal cord, are among the most common and most devastating types of injuries caused by auto accidents. According to the U.S. Centers for Disease Control and Prevention, 250,000 Americans injure their spinal cord each year. About 52 percent of these individuals are considered paraplegic and 47 percent quadriplegic. A majority of these spinal cord injuries occur between the ages of 16 and 30. The most common cause of spinal cord injuries is auto accidents (37 percent) followed by acts of violence (28 percent) and falls (21 percent).

Spinal cord injuries can result in permanent disabilities, which can have devastating emotional and financial consequences for the injured victim and his or her family. BISNAR | CHASE Sues for Wrongful Death During Strange Religious Ritual

The California personal injury lawyers at Bisnar | Chase are suing a Las Vegas church in a wrongful death suit after one of their incredibly bizarre religious rituals claims the life of a 16-year-old girl. Brianna Benbo was allegedly instructed by the Church of Divine Appointment, a.k.a. The Moment of Truth Ministries, to ingest a substance that contained bee pollen, which she was allergic to.

Benbo’s allergic reaction sent her into anaphylactic shock and she died from cardiac arrest and respiratory failure only hours later. The lawsuit is being brought against church owners Glories Powell and Lula Davis by Brianna’s mother Bridgette Jennings-Benbo. Powell can be seen ranting and raving in several youtube videos of her sermon, and from the videos, it seems her shock and awe performances are volatile and even dangerous.

Negligence and Wrongful Death in Nevada

The lawsuit claims that the capsules ingested by Benbo contained many ingredients, all of which weren’t known by the church, and included bee pollen which has been known to cause fatalities in people that are allergic to it. Despite these facts, the church still thought it was alright to give the pills to teenagers.

Brian Chase said, “The Defendants acted negligently, recklessly and tortuously by administering a potentially deadly cocktail of bee pollen and other chemicals to a girl with severe allergies to the substance.” He continued, “Not only did they manufacture and distribute the supplement while ignoring its health risks, they provided no warning to parishioners about its possible side effects. In short, their actions are directly responsible for Brianna’s unnecessary and untimely death.”

New Charges For Man Accused Of Driving College Roommate To Suicide

A grand jury in Middlesex County, NJ, has indicted a former Rutgers University student who allegedly used a webcam in 2010 to record his roommate engaging in a romantic encounter with another male student. The roommate, Tyler Clementi, committed suicide shortly after the video was made public. His death inspired a national conversation on the issue of bullying, and cyber-bullying in particular.

The 15-count indictment against Dharun Ravi, of Plainsboro, NJ, charges him with bias, invasion of privacy, witness and evidence tampering, and other charges relating to Clementi’s suicide. Ravi and another classmate had previously been criminally charged with invasion of privacy. (more…)

Massachusetts Boy Killed in Escalator Accident Donates Organs to 4 Patients

A tragic escalator accident in an Auburn mall which claimed the life of a 4-year-old Massachusetts boy resulted in a generous gift to four people after the boy’s family donated his organs.

The little boy, Mark DiBona, of Dudley, lost his life earlier this month after he fell from an escalator on the second floor of a Sears store at the Auburn Mall. He suffered fatal injuries to the head in the fall and died at a hospital the next day.

His family announced at his funeral that little Mark’s heart will be donated  to an 8-year-old boy waiting for a heart transplant. Furthermore, Mark’s liver was donated to a 6-month old baby, and his kidneys were given to two other patients. The identity of the recipients were not disclosed.

We have nothing but respect for Mark DiBona’s family who found strength in their pain to honor their boy by giving life to four other people in a desperate need of organ transplants. (more…)

Pedestrian Killed on Phoenix Highway

Did you know that 5,288 fatalities from the overall traffic fatalities in 2009 were individuals aged 65 and older (National Highway Traffic Safety Administration)? The most at-risk groups for pedestrian accidents are children aged between 5 and 9 years as well as adults aged 65 and older.

Arizona pedestrian deaths in 2009 were 15 percent or 120 persons killed from the 807 total fatalities. It is almost equivalent to the total motorcyclists who were killed due to vehicular accidents on the same year. Unfortunately, the number of pedestrian fatalities is only slightly lower than the number of deaths in 2008.

Around 3 a.m. last Friday, another pedestrian was struck by a car while trying to walk across a freeway ramp in Phoenix (AZ Family 03/04/11). Investigators believed that the victim, a 61-year old man, jumped over the retainer wall and crossed the street when the car heading west on the 202 to the 10 hit him. The man was pronounced dead at the scene. (more…)
